Article 1. Definitions

  1. The term "Client" shall be understood to mean any visitor to the internet site or any natural person who enters, or has entered into an agreement with Crafts & Co through the Crafts & Co web shop.
  2. Products" shall be understood to refer to all Crafts & Co articles, included in the sales assortment of the Crafts & Co webshop.

Article 2. Applicability

  1. All offers, orders, agreements and deliveries of Crafts & Co shall, to the exclusion of any other general conditions, be subject to the present General Conditions of Sale (hereinafter: Conditions). These conditions can also be consulted on internet: https://craftsandco.eu/algemene-voorwaarden/.
  2. These conditions shall apply to any contact between Crafts & Co and the customer, regardless of the means of communication used.
  3. Accepting an offer or placing an order implies that the Client accepts the applicability of these Terms.
  4. Deviations from the provisions of these conditions shall only be valid if expressly agreed upon by Crafts & Co in writing, in which case the remaining provisions shall remain in full force and effect.
  5. If also the Client refers to his general conditions, those conditions shall not apply, unless Crafts & Co has explicitly agreed to it in writing.
  6. All rights and claims, as stipulated in these conditions and in possible further agreements for the benefit of Crafts & Co, shall likewise be stipulated for the benefit of intermediaries and other third parties engaged by Crafts & Co.
  7. As far as these conditions have been drawn up in any other language than Dutch, the Dutch text shall always prevail.

Article 3. Offers / agreements

  1. All offers made by Crafts & Co shall be non-committal and Crafts & Co explicitly reserve the right to change prices, in particular when such is necessary in pursuance of (legal) regulations, with due observance of the stipulation in article 3.2.
  2. An agreement shall only be concluded after acceptance of the order of the customer by Crafts & Co. Crafts & Co is entitled to refuse orders or to attach certain conditions to the delivery, unless expressly stated otherwise. If an order is not accepted, Crafts & Co will announce this within ten (10) working days after receipt of the order.

Article 4. Prices and payments

  1. The prices mentioned for the offered products are in Euros, inclusive of VAT and exclusive of handling and shipping costs, possible taxes or other levies, unless otherwise mentioned or agreed upon in writing.
  2. If the prices for the offered products increase in the period between the order and its execution, the customer shall be entitled to cancel the order or to dissolve the agreement within ten (10) days after announcement of the price increase by Crafts & Co.
  3. In some cases there are promotional prices. Action prices are only valid for a certain period of time, as long as the stock lasts.
  4. The shipping and handling charges for orders up to € 20,00 (including VAT) will be 2,99 for deliveries within the Netherlands. Orders from € 20.00 with a destination within the Netherlands will be delivered for free.

Article 5. Delivery

  1. Orders will be delivered as soon as possible. Crafts & Co shall strive to deliver orders within 48 hours (except for weekends). The stock indications mentioned on the internet site are merely indicative and do not count as deadlines.
  2. Deliveries are only made in the Netherlands, Belgium, France and Germany. At the moment, we are unfortunately unable to deliver any orders with a different destination.
  3. If the delivery is delayed due to (temporary) lack of stock, or for other reasons, or if an order cannot or can only be partially carried out, the customer will be informed as soon as possible but no later than thirty (30) days after he has placed the order. In that case, customer has the right to cancel the order without any costs.
  4. Deliveries will be made to the address specified by the customer in his order unless otherwise expressly agreed in writing afterwards.
  5. As soon as the products to be delivered have been delivered to the indicated delivery address, the risk regarding these products is transferred to customer.

Article 6. Retention of ownership

  1. Notwithstanding the actual delivery, the ownership of the delivered products shall not be transferred to the client until the client has paid all he is due to Crafts & Co under any agreement. This includes payment of interest and costs, also of earlier or later deliveries.
  2. Prior to the transfer of ownership, the customer shall not encumber, sell, resell, dispose of or otherwise encumber the Products.

Article 7. Cooling-off period and right of withdrawal

  1. Customer is obliged to check the shipment immediately upon receipt and verify that the delivered products meet the purchase agreement. In the unlikely event that products do not comply, the customer must report this within seven (7) working days of delivery.
  2. For transactions with consumer buyers, which have been established through a web shop, the customer has the right to exercise a right of withdrawal without penalty and without giving reasons within seven working days after delivery of the product in question. On the site of Crafts & Co.eu under FAQ's it is described how this right of withdrawal shall be exercised.
  3. In case the customer has exercised his right of withdrawal as mentioned in 6.2., Crafts & Co. will see to it that any prepaid purchase amount, less a contribution to the shipping costs, will be refunded to the customer within thirty (30) days after revocation.

Article 8. Warranty

  1. The guarantee on the products is equal to the guarantee offered by the manufacturer.
  2. Claiming under the guarantee can be done by sending an email to info@craftsandco.eu mentioning customer number, invoice number and description of the problem. Or you can call (+31) 020-2614883 and the above details are at your fingertips.
  3. The invoice is proof of the guarantee.
  4. The guarantee does not apply if the damage is caused by injudicious use of the product.

Article 9. Communication

  1. For misunderstandings, delays or improper transmission of orders and notifications resulting from the use of internet or any other means of communication in the traffic between the customer and Crafts & Co, or between Crafts & Co and third parties, as far as they relate to the relation between the customer and Crafts & Co, Crafts & Co shall not be liable, except if and insofar as there is intent or gross negligence on the part of Crafts & Co.

Article 10. Force majeure

  1. In case of a force majeure situation Crafts & Co shall have the right, without prejudice to its other rights, to suspend the execution of the order of the Client, or to dissolve the agreement without judicial intervention, at its own discretion, by informing the Client thereof in writing, and without Crafts & Co being liable for any damages, unless, under the given circumstances, this would be unacceptable according to the standards of reasonableness and fairness.
  2. Force majeure shall be understood to mean any circumstance beyond the control of Crafts & Co, as a result of which the fulfilment of its obligations towards the customer is wholly or partly impeded.
  3. If the agreement has already been partially executed by Crafts & Co, the Client shall pay the selling price of the delivered Products.

Article 11. Intellectual and industrial property rights

  1. The Client shall fully and unconditionally respect all intellectual and industrial property rights of Crafts & Co.
  2. The client shall not be allowed to copy, partly or wholly alter the delivered Products or to provide them with another brand name or packaging, or to use the brand in any other way or to register it in his own name.
  3. Crafts & Co does not guarantee that the products delivered to the customer do not violate any (unwritten) intellectual and/or industrial right of ownership of third parties.

Article 12. Privacy statement

  1. Crafts & Co shall process the personal data of the Client only in accordance with its privacy statement, which shall be an integral part of these conditions.
  2. The privacy policy of Crafts & Co shall at least comply with the provisions of the Data Protection Act.

Article 13. Applicable law and competent court

  1. Dutch law applies exclusively to all rights, obligations, offers, orders, agreements and deliveries to which these Terms and Conditions apply.
  2. All disputes between parties shall be submitted to the competent court in the Netherlands.
